This Acceptable Use Policy (the “Policy”) outlines the prohibited actions and uses of the web hosting services and products provided by ValuedCloud LLC (the “Services”) and the website of ValuedCloud LLC located at http://www.valuedcloud.com (the “ValuedCloud LLC Website”). In using ValuedCloud LLC, either by accessing the ValuedCloud LLC Website or by using the Services provided, you automatically agree to the Policy. ValuedCloud LLC reserves the right to modify, change or otherwise update this Policy at any time by posting the newest version of the Policy on the ValuedCloud LLC Website. In the event of violation of any clause or section of the Policy, ValuedCloud LLC reserves the right to terminate or suspend your account and or your use of the Services without warning and without compensating the violating organisation or individual.
The Following Content is Strictly Prohibited:
- Promotion of illegal activities such as hacking, cracking, warez, identity theft, fraud, phishing and torrenting etc.
- Offensive Content including, but not limited to, child pornography, non-consensual sexual acts, hate speech, hate propaganda, threats, abuse, harassment or defamatory statements towards an individual or organisation.
- Harmful Content including, but not limited to, viruses, Trojan horses, worms, malicious code (information, links and instructions containing this) or content that is deemed in its sole discretion by ValuedCloud LLC to be harmful to ValuedCloud LLC and the Services we provide. This includes the use of scripts of systems that can cause performance issues to the servers we are providing.
- Content that infringes intellectual property or proprietary rights of others.
- Sale or solicitation of any harmful products or services including, but not limited to, fraudulent goods, Ponzi and pyramid schemes.
- Collection of personal information either for illegal purposes, spam purposes or without the user’s permission.
- Content that is deemed by ValuedCloud LLC, in its sole discretion, to bring the name of ValuedCloud LLC into disrepute.
- Network Abuse including, but not limited to, Monitoring/Crawling, Denial of Service attacks, avoiding System Restrictions and Intentional Interference and Information attacks.
ValuedCloud LLC takes a very strict and proactive stance on Spam and sending Unsolicited Commercial Email (UCEs). In using our Services, you agree that you will not distribute, send or facilitate the sending of UCEs or Spam, including, but not limited to, commercial advertising, informational announcements and any content that is strictly prohibited as listed above. Furthermore, in using our services you will not attempt to assume a sender’s identity without express permission from the party involved.
In the event that we are notified of an alleged violation of our policy regarding Spam and UCEs, we will begin an immediate investigation of the user involved. During this time, we may temporarily restrict or suspend your account to prevent further abuse of our service. If upon investigation a violation is found, ValuedCloud LLC reserves the right to terminate or suspend your account immediately, without compensation for the violating user or organisation. Furthermore, ValuedCloud LLC reserves the right to charge up to $2,000 for violations regarding spam or UCEs to cover fines, administration or other costs served to ValuedCloud LLC by our data carriers.
Furthermore, we may report activity that we suspect violates any law or regulation to the appropriate law enforcement officials. We may cooperate with the relevant law enforcement agencies, including disclosing customer information to aid investigation and prosecution of illegal activities committed on our servers and or through the service we are providing.
Our clients are solely responsible for the use of their account at all times. If, at any point, you become aware of a violation of this Policy, you agree to immediately notify us and provide us with assistance in order to remedy this violation.
